Stephen A. Smith

Stephen A. Smith was born in Scituate, Massachusetts and has lived in Florida since 2001. He received his undergraduate degree from Cornell University and graduated with honors from the University of Miami School Of Law in 1996.

Mr. Smith is a commercial litigator with extensive experience litigating insurance coverage; professional liability; contract and business disputes; construction issues; employment and labor defense; products liability; personal injury; and mass tort litigation, including aviation, medical devices and toxic torts. His work has included representing attorneys, accountants, insurance companies, insurance agents, employers and business partners in state and federal court proceedings, as well as arbitrations and mediations. He has also handled appellate work at the state and federal level, including the First and Eleventh Circuits, and the United States Supreme Court.

Mr. Smith has successfully represented large employers in various state and federal discrimination cases. He also has broad commercial and complex civil litigation experience on a national and local level, which includes: successfully vacating a Florida arbitration award based on bias; thereby causing the opposing party to enter into a settlement agreement on significantly more favorable terms than those set forth in the reversed award; representing partners’ in several different partnership dissolutions in Florida, California and Massachusetts; recovering contractual damages and entitlement to certain art work for the former manager of the Grateful Dead; punitive damage re-trial on remand of multi-defendant partnership/accounting breach - recovering several million dollars in attorneys’ fees; complex multi-defendant fraud action arising out of overseas banking project; multi-million dollar lender liability case arising out of bank’s failure to continue financing of Miami Beach hotel; successful trial against A. M. General for a defective Hummer under federal and state warranty law; breach of contract and Uniform Commercial Code revocation of acceptance case involving two million dollars worth of medical imaging equipment; products liability cases including Steffi-screw spine hardware, pantopaque dye; national multi-district litigation involving Dow breast implants, male implants, and the Chevrolet truck exploding side-gas tanks and writ to U.S. Supreme Court on issue of whether sibling is entitled to loss of society damages under Warsaw Convention and Death On the High Seas Act arising out of Korean Airlines disaster.

Mr. Smith works in the firm’s Palm Beach Gardens office.

Mr. Smith is admitted to the Florida, Massachusetts, and New Hampshire Bars and the Northern, Middle and Southern District Courts of Florida and all state and federal courts in Massachusetts and New Hampshire, and the U.S. Virgin Islands (pending). His interests include cycling, hiking and skiing.
